Avec ce livre, je réalise mon désir ancien et toujours actuel de participer à l'effort de nombreuses Algériennes depuis 1962, date de l'Indépendance, jusqu'à ce jour, pour obtenir le changement de ce statut archaïque et transformer le statut juridique des femmes dans la famille.

Je voulais démontrer l'archaïsme intolérable du statut réservé aux femmes par le Code algérien de la famille et offrir de la sorte aux militantes algériennes un argumentaire pertinent pour soutenir leur lutte dans un pays écartelé entre la modernité et la tradition. Modernité ? Les femmes ont envahi la presque totalité de la vie publique, politique, professionnelle, culturelle, sociale, et à de très hauts niveaux. Tradition ? Pour se marier, quel que soit son âge, une femme a besoin d'un " tuteur " ; elle peut être purement et simplement répudiée, sans pouvoir se défendre, et même se voir adjoindre une co-épouse, pour ne citer que les situations les plus flagrantes, tout cela au nom d'une certaine interprétation de ce que l'on appelle la " loi divine ".

Il me fallait donc commencer par démontrer que, en réalité, ce n'est pas à la loi divine, cette sharîa dont on ne cesse de parler pour brandir des interprétations d'un autre âge, qu'il faut imputer la survie d'un statut qui ne correspond plus à la réalité sociale actuelle, mais bien plutôt à la tradition patriarcale si puissante dans les régions méditerranéennes.
